1.1 Below we provide information about the collection of personal data when you use our website. Personal data is all data that can be personally related to you, such as your name, address, email addresses, and user behavior.
1.2 The responsible party according to Art. 4 Para. 7 EU General Data Protection Regulation (GDPR) is
Ocean Holdings AG
Moosstrasse 2
6003 Lucerne
Switzerland
Phone: +41 (0) 41 511 11 24
1.3 When you contact us by email or via a contact form, the data you provide (your email address, your name, and your telephone number, if applicable) will be stored by us in order to answer your questions. We will delete the data collected in this context once storage is no longer required, or restrict processing if statutory retention periods apply.
1.4 If we use contracted service providers for individual functions of our offering or wish to use your data for advertising purposes, we will inform you in detail below about the respective processes. We will also state the established criteria for the storage period.
1.5 WhatsApp
To communicate with our customers and other third parties, we use, among other things, the instant messaging service WhatsApp. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. Communication is carried out using end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the communication content. However, WhatsApp does receive access to metadata generated during the communication process (e.g. sender, recipient, and time). We would also like to point out that WhatsApp, according to its own statements, shares its users' personal data with its US-based parent company, Facebook. Further details on data processing can be found in WhatsApp's privacy policy at: https://www.whatsapp.com/legal/#privacy-policy. The use of WhatsApp is based on our legitimate interest in the fastest and most effective communication possible with customers, interested parties, and other business and contractual partners (Art. 6 (1) (f) GDPR). If consent has been requested, data processing will be carried out exclusively on the basis of this consent; this consent can be revoked at any time with future effect. The communication content exchanged between and on WhatsApp will remain with us until you request deletion, revoke your consent to storage, or the purpose for storing the data no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular retention periods—remain unaffected. We have configured our WhatsApp accounts so that it does not automatically compare data with the address book on the smartphones in use.

3.3 Use of cookies
a) Cookies
Our websites use cookies and similar technologies. Cookies are small text files that are stored by the internet browser on the user's device. A cookie usually contains a characteristic string of characters that allows the browser to be uniquely identified when the website is accessed again.
Cookies are used to make the website more user-friendly, to optimize the website's functions and services, and to provide you with content tailored to your needs.
The purpose of using technically necessary cookies is to enable and simplify the use of the website and the functions it provides. Some functions of this website cannot be offered without the use of cookies.
The user data collected through technically necessary cookies is not used to create user profiles.
In addition, with your separate consent, cookies may be used to provide external media such as films and maps, as well as to analyze website usage and other functions.
You can deactivate or restrict the use of cookies by changing the settings in your internet browser. Cookies already stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for the website, you may no longer be able to fully use all of the website's functions.
The legal basis for the processing of personal data using technically necessary cookies is Art. 6 (1) (f) GDPR, whereby the legitimate interest of the controller lies in the secure, stable, and efficient provision of the website's functions and the information accessible through them. If the controller fulfills a contractual obligation to you with the respective function, the legal basis is Art. 6 (1) (b) GDPR.
The legal basis for the processing of personal data using cookies for analysis purposes and for other non-technically necessary processing purposes is Art. 6 (1) (a) GDPR if the user has given his or her consent.
4. Other functions and offers of our website
4.1 In addition to the purely informational use of our website, we offer various services that you may be interested in. To do so, you will generally be required to provide additional personal data, which we will use to provide the respective service and to which the aforementioned data processing principles apply.
4.2 We sometimes use external service providers to process your data. These providers have been carefully selected and commissioned by us, are bound by our instructions, and are regularly monitored.
4.3 If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer.
4.4 On our website, we offer users the opportunity to register by providing personal data. The data is entered into an input mask and transmitted to us and stored. Data will only be passed on to third parties if and to the extent necessary to fulfill our contractual obligations to you (Art. 6 (1) (b) GDPR).
5. Objection or revocation against the processing of your data
5.1 If you have given your consent to the processing of your data, you can revoke it at any time. Such revocation will affect the legality of the processing of your personal data after you have expressed it to us.
5.2 If we base the processing of your personal data on a balance of interests, you may object to the processing. This is the case, in particular, if the processing is not necessary to fulfill a contract with you, which we will explain in the following description of the functions. If you exercise such an objection, we ask you to explain the reasons why we should not process your personal data as we do. If your objection is justified, we will examine the situation and either stop or adapt the data processing or explain our compelling legitimate reasons for continuing the processing.
5.3 Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time. You can inform us of your objection to advertising using the contact details provided above.
6. Newsletter and email distribution
6.1 With your consent, you can subscribe to our newsletter.
6.2 We use the so-called double opt-in process to register for our newsletter. This means that after you register, we will send you an email to the email address you provided, asking you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses and the times of registration and confirmation. The purpose of this process is to verify your registration and, if necessary, to investigate any possible misuse of your personal data.
6.3 The only mandatory information required to receive the newsletter is your email address. Providing additional, separately marked data is voluntary and will be used to address you personally. After your confirmation, we will save your email address for the purpose of sending you the newsletter. The legal basis is Art. 6 (1) (a) GDPR.
6.4 You can revoke your consent to receive the newsletter and unsubscribe from the newsletter at any time. You can revoke your consent by clicking on the link provided in each newsletter email or by sending a message to the contact details provided in the imprint.
6.5 We would like to point out that we evaluate your user behavior when sending the newsletter. For this evaluation, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. For the evaluation, we link the data mentioned in Section 3 and the web beacons with your email address and a unique ID. Links received in the newsletter also contain this ID. With the data obtained in this way, we create a user profile in order to tailor the newsletter to your individual interests. In doing so, we record when you read our newsletters, which links you click on in them, and use this to infer your personal interests. We link this data to actions you perform on our website.
You can object to this tracking at any time by clicking on the separate link provided in each email or by informing us via another contact method. The information will be stored for as long as you are subscribed to the newsletter. After unsubscribing, we store the data purely statistically and anonymously. Such tracking is also not possible if you have deactivated the display of images by default in your email program. In this case, the newsletter will not be displayed in full, and you may not be able to use all of its functions. If you display the images manually, the above-mentioned tracking will occur.
Cookies are stored on the basis of Art. 6 (1) (a) GDPR in conjunction with your consent.
We link this data to your Mailchimp account, The rocket science group LLC, 675 Ponce de Leon Ave. NE, Suite 5000, Atlanta, GA 30308, USA, if you have registered for our newsletter and/or created a customer account.
7. Web analysis
7.1 In order to tailor this website to meet your needs and optimize it, our partner Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland, uses solutions and technologies to collect and store data, and to create user profiles using pseudonyms. However, this data is not merged with data about the person using the pseudonym. When these technologies are used, cookies are stored locally. Visitors to this website can opt out of this data collection and storage at any time, including in the future.
The processing of your data is based on your consent in accordance with Art. 6 (1) (a) GDPR. You can revoke this consent at any time with future effect.

Only anonymized usage data is collected, aggregated, stored, and converted into user profiles with pseudonyms. The legal basis is Art. 6 (1) (a) GDPR in conjunction with your consent.
8. Usage-based advertising content
8.1 Use of Google Ads
We use “Google Ads” (formerly Google AdWords) on our website, a service provided by Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland (hereinafter referred to as “Google”). Google Ads enables us to draw attention to our attractive offers on external websites with the help of advertising media. This allows us to determine how successful individual advertising measures are. These advertisements are delivered by Google via so-called “ad servers.” For this purpose, we use ad server cookies, through which certain parameters for performance measurement, such as ad impressions or clicks by users, can be measured.
If you access our website via a Google advertisement, Google Ads stores a cookie on your PC. These cookies usually expire after 30 days and are not intended to identify you personally. Typically, the following analysis values are stored with this cookie: unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions), opt-out information (marking that the user does not wish to be addressed further). These cookies enable Google to recognize your web browser.
If a user visits certain pages of an Ads customer’s website and the cookie stored on their computer has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to that page. Each Ads customer receives a different cookie, so cookies cannot be tracked across the websites of Ads customers. We ourselves do not collect or process any personal data in the advertising measures mentioned. We only receive statistical evaluations from Google, which enable us to identify which of the advertising measures used are particularly effective. We do not receive any further data from the use of advertising media, and in particular, we cannot identify users based on this information.
Due to the marketing tools used, your browser automatically establishes a direct connection to Google’s server. We have no influence on the scope and further use of the data collected by Google through the use of Google Ads. To the best of our knowledge, Google receives the information that you have accessed the relevant part of our website or clicked on one of our ads. If you are registered with a Google service, Google can assign the visit to your account. Even if you are not registered with Google or are not logged in, it is still possible that Google may obtain and store your IP address.
We use Google Ads for marketing and optimization purposes, in particular to display advertisements that are relevant and interesting to you, to improve campaign performance reports, and to ensure a fair calculation of advertising costs. This also constitutes our legitimate interest in processing the above data by the third-party provider. The legal basis is Art. 6 (1) sentence 1 lit. f) GDPR.
You can prevent the installation of cookies by deleting existing cookies and disabling the storage of cookies in the settings of your web browser. Please note that in this case you may not be able to use all functions of our website to their full extent. You can also prevent the storage of cookies by configuring your browser to block cookies from the domain “www.googleadservices.com” (https://www.google.de/settings/ads). Please note that this setting will be deleted if you delete your cookies.
In addition, you can disable interest-based ads via the link http://optout.aboutads.info/. Please note that this setting will also be deleted if you delete your cookies.

8.2 Use of Google Dynamic Remarketing
We use “Google Dynamic Remarketing” on our website, a service provided by Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Ireland (hereinafter referred to as “Google”). Google Dynamic Remarketing enables us to display our advertisements to you during your further internet use after you have visited our website. This is achieved by cookies stored in your browser, through which your usage behavior when visiting various websites is recorded and evaluated by Google. In this way, Google can determine that you have previously visited our website.
According to Google, no merging of the data collected within the scope of remarketing with your personal data, which may be stored by Google, takes place. In particular, Google states that remarketing uses pseudonymization.
We use Google Dynamic Remarketing for marketing and optimization purposes, in particular to display advertisements that are relevant and interesting to you, to improve campaign performance reports, and to ensure a fair calculation of advertising costs. This also constitutes our legitimate interest in processing the above data by the third-party provider. The legal basis is Art. 6 (1) sentence 1 lit. f) GDPR.

8.3 Use of Facebook Pixel
This website uses the visitor action pixel from Facebook for conversion measurement. The provider of this service is Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, however, the collected data is also transferred to the USA and other third countries.
This allows the behavior of website visitors to be tracked after they have been redirected to the provider’s website by clicking on a Facebook advertisement. This enables the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and future advertising measures to be optimized.
The collected data is anonymous to us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible, and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy. This allows Facebook to display advertisements on Facebook pages as well as outside of Facebook. We as the website operator have no influence on this use of the data.
The use of Facebook Pixel is based on Art. 6 (1) lit. f GDPR. The website operator has a legitimate interest in effective advertising measures, including social media. If corresponding consent has been requested (e.g., consent to the storage of cookies), processing is carried out exclusively on the basis of Art. 6 (1) lit. a GDPR; consent can be withdrawn at any time.
Data transfer to the USA is based on the EU Commission’s Standard Contractual Clauses. Details can be found here:
Further information on protecting your privacy can be found in Facebook’s data policy: https://www.facebook.com/about/privacy/
You can also disable the remarketing function “Custom Audiences” in the ad settings section at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do this.
If you do not have a Facebook account, you can disable user-based advertising from Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/uk/your-ad-choices/
9. Social Media Social Media Plugins
9.1 This website uses social media plugins (e.g. Facebook, Twitter, Instagram).
You can usually identify the plugins by their respective social media logos. To ensure data protection on this website, we only use these plugins in conjunction with the so-called "Shariff" solution. This application prevents the plugins integrated into this website from transmitting data to the respective provider the first time you visit the site.
Only when you activate the respective plugin by clicking the corresponding button will a direct connection to the provider's server be established (consent). As soon as you activate the plugin, the respective provider receives the information that you have visited this website using your IP address. If you are logged into your respective social media account (e.g., Facebook) at the same time, the respective provider can assign your visit to this website to your user account.
Activating the plugin constitutes consent within the meaning of Art. 6 (1) (a) GDPR. You can revoke this consent at any time with effect for the future.
Instagram plugin
This website integrates features of the Instagram service. These features are offered by Facebook Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
If you are logged into your Instagram account, you can link the content of this website to your Instagram profile by clicking the Instagram button. This allows Instagram to associate your visit to this website with your user account. Please note that, as the provider of these pages, we have no knowledge of the content of the transmitted data or how it is used by Instagram.
The data is stored and analyzed on the basis of Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the most comprehensive visibility possible on social media. If consent has been requested, processing will be carried out exclusively on the basis of Art. 6 (1) (a) GDPR; consent can be revoked at any time.
Data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum,https://help.instagram.com/519522125107875
and https://de-de.facebook.com/help/566994660333381 . Further information can be found in Instagram's privacy policy: https://instagram.com/about/legal/privacy/ .
10. Linked content / sharing functions
Our website contains links to our presence on social networks and the option to share content from our website via social networks. When providing these functions, no personal data is collected until you use the corresponding function after logging in to the respective provider. The respective privacy policies and data protection notices of the respective platform operators apply. We point out that we are not responsible for the data processing practices on third-party platforms outside of our own sphere of influence.
